After a joint trial, the three defendants
were convicted by a jury of breaking and entering a
commercial vehicle in violation of 53-74 of the
General Statutes. The pertinent portion of 53-74
makes it a criminal offense to break and enter a
commercial motor vehicle with the intent to commit
a crime therein. Following his conviction, one of the
defendants, Donald McGinnis, was found guilty
under the second part of the information which had
been filed against him, charging him with being a

second offender. General Statutes 54-118. The
three defendants have appealed from the judgments,
claiming that the verdicts are against the evidence
and that the court made an erroneous ruling on
evidence. In accordance with the defendants' request,
the court ordered the cases consolidated for this
appeal.
