The defendant has appealed from orders overruling his demurrer to the amended petition, his demurrer to plaintiff's evidence, his motion for a directed verdict, his motion to set aside answers to special questions, his motion for judgment non obstante, his motion for a new trial, and from the judgment entered by the trial court. In the face of the record presented the amended petition, which was attacked by demurrer on the basis it failed to state facts sufficient to constitute a cause of action in that it showed on its face that plaintiff was guilty of contributory negligence as a matter of law, is subject to a liberal construction under our statute (G.S. 1949, 60-736).
